By accessing our website, making a reservation, or using any of our services, you ("Guest", "you") confirm that you have read, understood, and agree to be bound by these Terms in full. If you do not accept any part of these Terms, please refrain from using our website or services.

These Terms are governed by the laws of India, including but not limited to the Consumer Protection Act, 2019, the Information Technology Act, 2000, and applicable regulations of the State of Kerala.

2. Resort Information

Seetharkundu Resorts is an eco-tourism property situated in the scenic hills of Kollengode, Palakkad, Kerala, steps from the Seetharkundu Waterfalls and the Nelliyampathy foothills. We are committed to responsible tourism, sustainable hospitality, and immersive nature-based experiences.

Accommodation tariffs are subject to applicable Goods and Services Tax (GST) as per prevailing Indian tax laws. GST rates will be displayed at the time of booking confirmation.

3. Booking Policy

3.1 Reservation Confirmation

• Reservations are confirmed only upon receipt of the required advance payment.
• A booking confirmation will be sent via email, WhatsApp, or SMS to the contact details provided.
• The Resort reserves the right to decline any booking at its discretion.

3.2 Payment Terms

• Full or partial advance payment may be required depending on booking type and season.
• Accepted methods: UPI, NEFT/RTGS bank transfer, debit/credit cards, and approved online payment gateways.
• All payments are in Indian Rupees (INR).

3.3 Pricing

• All tariffs are subject to change without prior notice.
• Seasonal pricing, festival tariffs, and special package rates may vary.
• Quoted rates are exclusive of GST unless explicitly stated otherwise.

4. Cancellation & Refund Policy

4.1 Guest Cancellation

• 14 days or more before check-in: Eligible for a partial or full refund, subject to management discretion and applicable processing charges.
• 7 to 13 days before check-in: Partial refund may be considered at management discretion.
• Within 7 days of check-in: No refund will ordinarily be granted.
• Peak season and public holiday bookings may carry separate, more restrictive cancellation terms communicated at the time of booking.
• All refunds, where applicable, will be processed within 7–14 working days to the original payment source.

4.2 Resort-Initiated Cancellation

In extraordinary circumstances - including natural disasters, government-mandated closures, or operational exigencies - the Resort may cancel confirmed reservations. In such cases, guests will be offered one of the following at the Resort's discretion:

• Rebooking for alternative dates at no extra charge,
• Credit vouchers valid for future stays, or
• A full refund of amounts paid.

The Resort shall not be liable for any incidental costs (travel, transport, etc.) incurred by the guest in such events.

5. Check-In & Check-Out

• Standard Check-In Time: 12:00 Noon
• Standard Check-Out Time: 11:00 AM
• Early check-in or late check-out is subject to availability and may attract additional charges.
• All guests must present a valid government-issued photo ID (Aadhaar, Passport, Driving Licence, Voter ID) at check-in, as required under applicable police verification rules.
• Foreign nationals must present a valid Passport and Visa for registration.

6. Guest Responsibilities & Code of Conduct

All guests are expected to:

• Treat resort property, staff, local communities, and the natural environment with respect.
• Refrain from damaging flora, fauna, or eco-sensitive areas within or around the resort.
• Follow safety instructions during trekking, campfires, plantation walks, and other outdoor activities.
• Maintain appropriate decorum and avoid disturbing fellow guests.
• Comply with all applicable laws of India and the State of Kerala during their stay.

The Resort reserves the right to ask any guest to vacate the premises without refund in cases of misconduct, illegal activity, intoxication leading to disturbance, or behavior compromising the safety or comfort of others.

6.1 Children Policy

• Children below 12 years may stay complimentary (without an extra bed) when accompanied by parents/guardians.
• Parents and guardians are responsible for supervising children at all times, particularly near water bodies and forest trails.

6.2 Alcohol & Smoking Policy

• As an eco-resort surrounded by sensitive forest areas, open alcohol consumption in outdoor/forest zones is discouraged and subject to local regulatory restrictions.
• Smoking is strictly prohibited inside rooms and indoor common areas.
• Designated areas, if available, will be communicated by staff upon check-in.

7. Eco-Tourism & Environmental Responsibility

Seetharkundu Resorts is committed to sustainable hospitality. Guests are requested to actively support our initiatives, including:

• Responsible waste segregation and disposal,
• Minimising single-use plastic within the resort premises,
• Conserving water and electricity,
• Respecting wildlife and refraining from feeding or disturbing animals,
• Staying on designated trails during nature walks and treks.

8. Activities & Outdoor Experiences

The Resort may organise or facilitate activities including, but not limited to:

• Nature and plantation walks
• Trekking and hill climbing
• Sightseeing excursions
• Campfires and outdoor dining
• Mountain cycling and adventure experiences

Participation in outdoor and adventure activities is entirely voluntary. Guests are responsible for assessing their own physical fitness and medical suitability before participation. Guests with pre-existing medical conditions are advised to consult a physician prior to joining such activities.

The Resort shall not be liable for injuries, accidents, or losses arising from participation in outdoor activities, except where such harm is directly attributable to the proven negligence of Resort staff. The Resort will take reasonable precautions for guest safety at all times.

9. Liability Disclaimer

• The Resort shall not be liable for loss, theft, or damage to guests' personal belongings. Guests are advised to use in-room safes where available and to safeguard their valuables.
• The Resort is not responsible for delays, disruptions, or service interruptions caused by adverse weather, natural events, road conditions, power outages, strikes, or other circumstances beyond reasonable control.
• Nothing in these Terms limits our liability for personal injury or death caused by our negligence, or for any other liability that cannot be excluded under applicable Indian law.

• Natural disasters, floods, landslides, or earthquakes;
• Pandemic, epidemic, or public health restrictions;
• Government orders, regulations, or prohibitions;
• Power failures, telecommunications outages;
• Acts of war, civil unrest, or terrorism.

In the event of a Force Majeure Event, the Resort will notify guests as promptly as practicable and will endeavour to offer alternative dates or other remedies where feasible.

13. Amendments to These Terms

Seetharkundu Resorts reserves the right to amend these Terms at any time. Updated Terms will be published on this page with a revised "Last Updated" date. Continued use of our website or services after such updates constitutes acceptance of the revised Terms.

14. Governing Law & Dispute Resolution

These Terms shall be governed by and interpreted in accordance with the laws of India. Any disputes arising from or related to these Terms or your use of our services shall be subject to the exclusive jurisdiction of courts located in Palakkad, Kerala, India.
